Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your use of the AUDIOVIZOR software and services (“Service”) operated by ShortGenie.ai (“we”, “us”, “our”), based in Edmonton, Alberta, Canada. By accessing or using the Service, you agree to be bound by these Terms.

2. Service Description

AUDIOVIZOR is a GPU-accelerated audio visualizer available as a web application and a desktop application for Windows. The Service provides real-time 3D audio visualization, beat detection, visual presets, and video export capabilities.

3. Account Terms

  • You must be at least 16 years of age to use this Service.
  • You may only maintain one account per person.
  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must provide accurate and complete information when creating an account.

4. Plans & Pricing

The Service is offered under the following plans:

  • Free — All visual presets, 15-minute sessions, file upload audio, and 720p video export with watermark.
  • Unlimited ($4.99 CAD/month) — Unlimited sessions, file + mic + system audio input, up to 4K clean video export, full preset editor, desktop application, video overlays, cloud sync, and batch export.

All prices are in Canadian Dollars (CAD). We reserve the right to change pricing with 30 days notice to existing subscribers.

5. Billing & Payments

  • All payments are processed securely through Stripe. We do not store your credit card information.
  • Unlimited subscriptions renew automatically each billing cycle until cancelled.
  • You may cancel your subscription at any time through your account billing portal. Cancellation takes effect at the end of the current billing period.

6. Refund Policy

We offer a 14-day money-back guarantee for all paid plans. If you are not satisfied with the Service, contact us at contact@shortgenie.ai within 14 days of your purchase for a full refund. Refunds are processed through the original payment method via Stripe.

7. Lifetime Plan

  • The Pro Lifetime plan grants a perpetual license to use the current version and all future updates of the Service for as long as it operates.
  • The Lifetime plan does not guarantee that the Service will operate indefinitely. If we discontinue the Service, Lifetime plan holders will retain access to the desktop application.
  • “Lifetime” refers to the lifetime of the product, not the lifetime of the purchaser.

8. Commercial Usage

  • Plus and Pro plan users may use video exports and screenshots from AUDIOVIZOR for commercial purposes, including social media content, live streams, music videos, and presentations.
  • You may not resell, redistribute, or sublicense the AUDIOVIZOR software itself.
  • You may not use the software to create a competing audio visualization service.

9. Desktop Application (EULA)

The following additional terms apply to the AUDIOVIZOR desktop application:

  • The desktop application is licensed, not sold. You receive a limited, non-exclusive, non-transferable license to install and use it on your personal machines.
  • The desktop application requires an active Pro subscription or Lifetime license to use.
  • The application includes an auto-update mechanism that may download and install updates automatically.
  • You may not decompile, reverse engineer, or disassemble the desktop application, except to the extent permitted by applicable law.

10. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Circumvent, disable, or interfere with license verification or access controls.
  • Share your account credentials or allow others to access your account.
  • Use the Service to distribute malware or engage in any unlawful activity.
  • Attempt to gain unauthorized access to any part of the Service or its related systems.

11. Intellectual Property

  • The AUDIOVIZOR software, visual presets, branding, and all related intellectual property are owned by ShortGenie.ai.
  • You retain full ownership of any audio content you provide and any video exports you create using the Service.
  • We do not claim any rights to your content or exports.

12. Limitation of Liability

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. To the maximum extent permitted by law, ShortGenie.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total aggregate liability shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Termination

  • We may suspend or terminate your access to the Service if you violate these Terms, with or without notice.
  • You may delete your account at any time by contacting us at contact@shortgenie.ai.
  • Upon termination, your right to use the Service ceases immediately, except for any surviving provisions (e.g., intellectual property, limitation of liability).

14. Changes to These Terms

We may update these Terms from time to time. For material changes, we will provide at least 30 days notice via email or through the Service. Your continued use of the Service after the notice period constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Alberta, Canada, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Edmonton, Alberta, Canada.
